6. Limitation of Liability UNAVOIDABLE DAMAGES & RELEASE
Moving services involve inherent risks due to the size, weight, and nature of household goods, as well as the physical conditions of pickup and delivery locations. The Client acknowledges and agrees that certain minor or cosmetic damage may occur despite the exercise of reasonable care by the movers.
“Unavoidable Damages” are defined as minor, incidental, or cosmetic damages that occur as a direct result of access limitations, item characteristics, or pre-existing conditions, and which are not caused by negligence or willful misconduct of the Service Provider.
Unavoidable Damages include, but are not limited to:
• Minor scuffs, scratches, dents, chips, or marks on walls, floors, ceilings, door frames, railings, stairwells, elevators, or common areas
• Minor cosmetic damage to furniture or items resulting from tight clearances, narrow hallways, staircases, elevators, low ceilings, sharp turns, or restricted access
• Damage caused by the size, weight, shape, or fragility of items relative to the available access points
• Damage resulting from items that are previously worn, weakened, cracked, warped, unstable, or improperly assembled
• Damage to items made of particle board, laminate, veneer, glass, marble, stone, or similar materials prone to stress or breakage
• Minor fabric stretching, compression marks, surface wear, or padding impressions resulting from necessary handling and positioning
• Damage resulting from environmental or structural conditions, including uneven floors, low clearance ceilings, narrow landings, poor lighting, weather conditions, or inadequate access paths
• Damage resulting from the Client’s failure to properly pack, prepare, secure, or disclose the condition of items
• Damage resulting from items moved at the Client’s direction despite warnings of risk provided by the Service Provider
The Client confirms that they have inspected the pickup location, access points, and destination, and accepts the conditions as suitable for moving services.
The Client further acknowledges that unavoidable damages are not subject to repair, replacement, or compensation, except as required by applicable law.
7. Termination of Services
We reserve the right to terminate or suspend services at our discretion, including for non-payment, failure to comply with these Terms, or behavior that endangers our staff or operations. You may cancel your service request by contacting us, subject to any applicable cancellation fees outlined during booking.
8. User Content and Feedback
Any feedback, inquiries, or content you provide to us (e.g., via our website contact form or social media) may be used to improve our services. By submitting content, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for business purposes, including marketing, with your consent where required.
9. Governing Law
These Terms are governed by the laws of Ontario, Canada, and applicable federal laws of Canada. Any disputes arising from these Terms or our services will be resolved in the courts of Ontario.
